NY Firearm laws for ARs (“Assault Weapons”)

NYS Gun Laws pertaining to AR/ Semi-Automatic Rifles

NYS Penal Law §265.00, 22(a); 

“Assault weapon” means:

(a) a semiautomatic rifle that has an ability to accept a detachable magazine and has at least 1 of the following characteristics:
   (i) a folding or telescoping stock;
   (ii) a pistol grip that protrudes conspicuously beneath the action of the weapon;
   (iii) a thumbhole stock;
   (iv) a second handgrip or a protruding grip that can be held by the non-trigger hand;
   (v) a bayonet mount;
   (vi) a flash suppressor, muzzle break, muzzle compensator, or threaded barrel designed to accommodate a flash suppressor, muzzle break, or muzzle compensator;
(vii) a grenade launcher;

Translation: Do not build or possess an AR with items (i)-(vii).

Registration of Assault Weapons, pertaining to Rifles

§265.00, 22

(f) a semiautomatic rifle, a semiautomatic shotgun or a semiautomatic pistol or weapon defined in paragraph (a) , (b) or (c) of this subdivision, possessed prior to the date of enactment of the chapter of the laws of 2013 which added this paragraph.

NYS § 400.00 Licenses to carry, possess, repair and dispose of firearms.

16-a. Registration. (a) An owner of a weapon defined in paragraph (e) or (f) of subdivision 22 of section 265.00 of this chapter, possessed before the date of the effective date of the chapter of the laws of 2013 which added this paragraph, must make an application to register such weapon with the superintendent of state police, in the manner provided by the superintendent, or by amending a license issued pursuant to this section within one year of the effective date of this subdivision except any weapon defined under subparagraph (vi) of paragraph (g) of subdivision 22 of section 265.00 of this chapter transferred into the state may be registered at any time, provided such weapons are registered within thirty days of their transfer into the state.

GUNS!!!! (Legal Information)

Hello to all reading this post.

I am thinking of starting a website, free for the time being, that informs the public of New York about the firearm laws pertaining to New York (State and City).

It might involve other states later on but I am first wanting to inform New York state residents. If you are in another state, please research your State’s laws and send the information. Your research will help to update your State’s laws to the website easily and quickly.

I know that some people might not visit a website such as: https://www.nraila.org, due to political and/or social opinions; Therefore, the website will be focused on informing LGBT+, African-Americans, Hispanics/Latinos and other minority groups.

I have noticed there is either a fear or misinformation of firearms among the aforementioned groups. We the people need more informed Americans (and New Citizens, Congratulations!) willing to exercise their rights granted by the Bill of Rights.

My wish

I wish I was not born white; If not, I would make aware my brother’s and sister’s plight.

I was almost born dead, the umbilical was wrapped around my head.

In the womb I was almost killed with a noose; If I were black, all terror would have been loose.

The terror of birth in the womb, then straight to the tomb.

A society of population control, running toward an early grave.

A band of miscreants enthralled, voting to remain enslaved.

Seven-hundred dead in Chicago in November alone.

Massive chains dragging souls, cursed by the stone.

Change will arrive when the community is truly outraged.

Gone are the days of sympathy and pity.

Now are the days of justice and death.

You sowed the seeds of death and despair.

Black Lives Matter when there is no thought of the innocent slain in the womb.

Cursed is your generation and those after.

Fix your own house before you try to fix your neighbour’s.

Black Lives Matter

  • When it is an election year for Democrats.
  • When you do not pay attention to gun violence in gun controlled Democrat cities.
  • When a white Liberal, Socialist feels the need to be your savior.
  • When you are a mental slave to the Liberal, Socialist agenda.
  • When there is no true dialogue for real progress.
  • When every problem you have, makes you think you need a white person to fix it for you.
  • When you disregard the abortion rates in the black community.
  • When you do not think about the NINETY PERCENT homicide rate in THIRTEEN PERCENT of the population.
  • When facts of black on black homicide in Barrack Obama’s city of Chicago are ignored. 2016 Chicago violence rates
  • When hypocritical gangbangers that kill their own race scream “No Justice, No Peace”.
  • When you do not listen to the outrage of black people that are trying to get their message heard. Blacks against Black Lives Matter , Ladies making sense

Public vs Police

In the past month, we have seen what happens when hate speech is treated equal to free expression. Specifically, “Pigs in a blanket, Fry them like bacon” and “Kill the police and white people.” I personally do not agree with these statements. They are detrimental to the safety of every citizen, as seen in Dallas members of a rally were also injured. 

Yes, granted there are issues of individual racism in society. However, that does not mean that every single police officer is a racist, nor does it mean that every single person of a skin color is racist. In my opinion, the best solution is to look at the individual and hold them accountable for their actions. That is the whole idea of personal responsibility. When generalizations are made, many that have nothing to do with the issue are affected in a very negative way.

I do support the theory of Black Lives Matter, not the practical application. When there is a higher rate of murder of innocent people within a community, one might want to solve the issues closer to the community before applying solutions outside of the community. 

Why is it that there are not many big name civil rights leaders going into Chicago, Detroit, Los Angeles and other predominately Black areas? Might it be due to the problem of theory needing to be revised when the practical application does not work?

I will respect the BLM, and any other activist program for the betterment of communities, when they stop saying slogans/ carrying banners and do some real community work. Real work such as educating the illiterate, organizing community business organizations and other real programs that are not supported by unseen and unaccountable funds.
